These Terms and Conditions ("Terms") govern your use of the website located at eurekadeckandfence.com and your engagement with the services offered by Precision Eureka Deck & Fence ("we," "our," or "us"). By using this website or engaging our services, you agree to these Terms. If you do not agree, please do not use this website or request our services.
By accessing this website, submitting a contact or estimate request, or entering into a written agreement with us for services, you acknowledge that you have read, understood, and agree to be bound by these Terms. We may update these Terms from time to time. Continued use of this website or our services after an update constitutes acceptance of the revised Terms.
Precision Eureka Deck & Fence provides residential and commercial deck building, fence installation, pergola construction, and related outdoor structure services in Eureka, California, and surrounding areas of Humboldt County. Services are provided pursuant to a separate written contract signed by both parties before work begins.
Information on this website is provided for general informational purposes only. Nothing on this website constitutes an offer to perform specific work at a specific price. All pricing is subject to a site visit and written proposal.
All estimates provided by Precision Eureka Deck & Fence are based on information available at the time of the site visit and proposal. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Final pricing is set forth in the written contract. Changes to the scope of work after a contract is signed may result in additional charges. Any change order must be agreed to in writing by both parties before additional work is performed.
Permit fees, utility markings, unforeseen site conditions (such as buried obstacles, unstable soil, or pre-existing damage discovered during construction), and customer-requested changes are not included in the original estimate unless specifically noted.
Project start dates are established at the time of contract signing and are subject to permit approval timelines, material availability, and weather conditions. We will notify you of any significant changes to your scheduled start date.
If you need to cancel or reschedule, please contact us as soon as possible. Deposits paid prior to cancellation may be non-refundable if materials have already been ordered or work has begun, as detailed in your individual contract.
We reserve the right to reschedule work due to weather, supplier delays, or circumstances beyond our control. We will communicate proactively and work to minimize any impact on your timeline.
Payment terms are set forth in the written contract for each project. A deposit is typically required before work begins. The remaining balance is due upon completion and final walkthrough, unless a different schedule is specified in writing.
Accepted payment methods will be specified in the contract. Payments not received by the due date may be subject to a late fee as specified in the contract.
In the event of non-payment, we reserve the right to stop work, retain any deposits applied to materials and labor already provided, and pursue collection through available legal means, including the filing of a mechanic's lien under California law.
Where required by local ordinance or California law, we will apply for and obtain necessary building permits on your behalf as part of the contracted work. Permit fees are the responsibility of the customer and will be disclosed in the written proposal.
The customer is responsible for ensuring that the property is accessible, that property lines are accurately represented, and that any HOA or deed restriction approvals required for the project have been obtained before work begins.
We stand behind our workmanship and will address defects in labor and materials that arise from our installation, as detailed in the written contract for each project. Manufacturer warranties on materials (such as composite decking or railing products) are separate and are provided by the manufacturer directly.
Our workmanship warranty does not cover damage caused by misuse, neglect, normal wear and tear, acts of nature, or modifications made by others after project completion.
This website and its content are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by applicable law, Precision Eureka Deck & Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website or our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of a service contract shall not exceed the total amount you paid us under that contract. Some states do not allow limitations on implied warranties or exclusions of consequential damages, so some of the above limitations may not apply to you.
All content on this website - including text, images, logos, and graphics - is the property of Precision Eureka Deck & Fence or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this website without our prior written permission.
We prefer to resolve any disagreement directly and informally. If you have a concern about a project, please contact us first so we have the opportunity to address it.
If a dispute cannot be resolved through direct communication, both parties agree to first attempt resolution through non-binding mediation before pursuing litigation. Mediation shall take place in Humboldt County, California, unless both parties agree in writing to a different location.
Nothing in this section limits either party from seeking emergency injunctive relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
These Terms and any disputes arising out of your use of this website or our services shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action shall be brought in the state or federal courts located in Humboldt County, California.
We may update these Terms from time to time. When we do, we will update the Effective Date at the top of this page. Your continued use of this website or engagement with our services after any changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
